The running of the charity is subject to the Governing document. A copy of which can be obtained by writing to us.

By donating to Kicking Off Against Cancer, you agree that your donation will be used in any way fit by the charity trustees in order to help support good causes, and/or the running of the Charity itself

All donations are collected by Kicking Off Against Cancer (Charity no. 1174092).

Online donations are subject to a deduction of the fees of the payment gateway, meaning that less than 100% of online donations can be used by the charity.

More information on this can be received by getting in touch with us in writing.

Single donations will be one off payments. No further payments will be taken from you if this option is selected.

Monthly recurring donations shall be as stated. They will be taken on or as near as possible the same day of the month as the initial donation. Until you notify us that this should no longer be the case.

All requests for refunds of donations should be made by the donor to [email protected]. Refunds are made in accordance with the UK Charities Act 2011 and the Fundraising Regulator Code of Fundraising Practice. Refund requests must be made within 7 days of the donation being made.

Your personal information received during the donation process shall be used in accordance with our privacy policy.

We endeavour to provide an update on our good causes on a regular basis, providing an honest and transparent view of how the charity is helping and making a difference in the community.

We reserve the right to update these terms and conditions as and when is necessary. Any relevant updates will be communicated via this page so it should be checked regularly.

Online auctions

These Auction Terms & Conditions are in place to govern any bids placed as part of an auction run by Kicking Off Against Cancer (KOAC). By placing a bid and participating in the auction, you agree to be bound by these terms.

1. Auction Details
1.1 All proceeds from this auction will go to KOACto be used by the board of trustees to further the charities Charitable Objectives
1.2 100% of the winning bids will be received by KOAC. No commissions or deductions are made from any winning bids
1.3 The auction will run from 14:00 on the 01stDecember 2019 and will close at 00:59 on 13thDecember 2019. Bids placed outside of this time frame will not be accepted.
1.4 KOAC reserves the right to close the auction early or extend the auction at its discretion
2. Auction Items
2.1 All items available for the auction are displayed in picture form on our website
2.2 By placing a bid, you confirm that you understand what the item is and that the description and photograph contains a sufficient level of information to enable you to make an informed decision of the item you are bidding on
2.3 Should you need more information on any item you can contact KOAC via the website
2.4 – No responsibility will be accepted by KOAC for any item received by the winning bidder in the instance that they have not understood the description of the item
2.5 Items purchased through the auction are non-refundable and non-exchangeable
3. Who Can Bid
3.1 No trustee or official member of KOAC may enter a bid into the auction
3.2 No one under the age of 18 can enter a bid into the auction
3.3 KOAC, at its discretion, may ask for proof of agebefore sending out any items
4. Bidding Process
4.1 You may only place a bid online through the relevant section of KOACs website
4.2 By entering a bid on any of the items, you will be entering into a binding agreement by which you are committing to buy the lot you have bid on and pay the price you have bid
4.3 Items with reserve prices will not be sold unless these reserves are met, unless the Trustees of KOAC decide to do so
4.4 All bidders will receive an e-mail outlining the details of their bid, the winning bidder will then receive a confirmation email outlining the item they have won and details of the winning bid
4.5 All bids are in Pounds Stirling
4.6 All winning bidders will receive further information for payment and request for shipping details
4.7 the winning bid will be the highest bid that complies with these Terms & Conditions
4.8 Bids may be placed on multiple items, so long as the bidder meets the Who Can Bid criteria
4.9 Bidders name and bid amount will appear on the website under the item page
5. Payment
5.1 KOAC will provide full payment details to the winning bidder, at which point you will have five (5) working days to make payment of the winning amount in full
5.2 KOAC reserves the right to offer the item(s) to the next highest bidder in the event there is an issue with payment
5.3 Payment must be made via bank transfer
5.4 Unless agreed by the Board of Trustees, no item will be shipped until payment is received
5.5 Ownership and Risk will pass to you, the winning bidder when we receive full and final payment
6. Event Items
6.1 If the item is for an Event, KOAC will provideyou with all the details and information, including ay limitations, for the winning bidder to book the event
6.2 Unless specifically stated, KOAC are not responsible for the booking of any event
6.3 Events have been donated to the auction on the understanding that they will be attended by the successful bidder and any guest(s) up to the maximum number specified in the information
6.4 Should the winning bidder wish to give the Event Item as a gift, approval must be obtained by the board of trustees
6.5 Under no circumstances, should these events be re-sold, in such an instance, the donor or third party are entitled to refuse the event with out refund by them or KOAC
6.6 When undertaking events, the winning bidder and any guest(s) is bound strictly to the terms & conditions of the venue
6.7 Unless specifically detailed in the event, associated costs, including but not limited toequipment hire, travel, sustenance and accommodation are the responsibility of the winning bidder
7. Delivery
7.1 Delivery/Collection of the winning items will be arranged with the item winner once payment has been made
7.2 While every effort is made, KOAC will not be held responsible for any loss or damage of any item in transit. Should insurance or special delivery be required for an item, KOAC reserve the right to pass on any additional costs to the winning bidder
8. General
8.1 This Agreement shall not create, nor shall it be construed as creating, any partnership or agency relationship between the parties
8.2 This Agreement and the rights and obligations of both parties shall be governed by, and construed in accordance with, the laws of England and Wales, the parties irrevocably agree to submit to the exclusive jurisdiction of the courts of England and Wales
8.3 KOAC shall not be liable for any delay or default in the execution of its obligations in the case of any event outside its control including but not limited to natural disasters, bad weather, fires, explosions, floods, failure or delay of third party suppliers, internet connection failures, computer hardware or software failures or errors, national strikes, accidents, riots, acts of terrorism, war or civil uprisings.
8.4 The Decision of the Board of Trustees shall be final and unchallengeable and in their absolute discretion they may declare any entry void. The board may authorise a representative to undertake any or all the functions under these terms
8.5 KOAC reserves the right to amend these terms & conditions at any point and without prior notice

Applications for funding (apply to make memories)

  1. Whilst every effort is made to meet your requirements, we cannot guarantee, should you be successful in your application, that we will can meet all scenarios. Alternatives may be offered.
  2. If school term times are requested, then Kicking Off Against Cancer (KOAC hereafter) strongly advise that you seek permission from the school. KOAC will not be held responsible for any repercussions from a child missing school.
  3. In the instance that the event has been booked and you cannot attend, KOAC do not guarantee that a date can be moved or re-booked, in this case we will review the scenario surrounding the postponement.
  4. In the unlikely event of a cancellation arising due to a third party company chosen by us, we may seek compensation from that company to recoup any of our funds spent. However, we cannot be held responsible for any monies spent by the applicant.
  5. Upon a successful application KOAC do not agree to pay the applicant any monies directly, unless confirmed in writing. All transactions will be organised between KOAC and the venue or vendor.
  6. The charity do not accept any liability for any injury sustained during your event, it is the applicant’s responsibility to ensure that appropriate insurances are in place for the activity.
  7. The event will be organised by the charity for the persons outlined in this application, any change in attendees must be accepted in writing by KOAC at least 1 week prior to the event.
  8. The budget for the event will be set by the board of trustees, based on the application and our best judgement. If successful, you will receive confirmation of what KOAC will pay for, all costs outside of this are the responsibility of the applicant. It is the applicant’s responsibility to ensure they are not putting themselves under financial pressure by participating in the event.
  9. The charity cannot accept any responsibility whatsoever for any financial losses suffered by the applicant whilst participating in the event.
  10. The charity reserves the right to not enter into communication, be it verbal or written should it decide against an application, other than to notify the applicant that it has not been successful.
  11. Only one application will be considered per household.
  12. KOAC reserve the right to question the applicant on the information provided, and request further detail from the person endorsing the application. Any applications found to be fraudulent will result in the details being passed to the appropriate authorities.
